Terms of Service

The short version. By using this website, you agree that the estimates, interactive tools, and information on it are illustrative only — actual pricing, scope, and service happen in writing with a West Sound Comfort Systems technician. Disputes are resolved through binding individual arbitration (you have 30 days to opt out), and Washington law governs. Full terms below.

1. Acceptance of these Terms; eligibility

These Terms of Service (the “Terms”) are a binding agreement between you and West Sound Comfort Systems, a Washington business (“West Sound Comfort Systems,” “we,” “us,” or “our”), governing your access to and use of the website located at westsoundcomfort.com and any interactive tools, forms, or content made available through it (the “Site”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. You must be at least 18 years of age and legally able to enter into a contract to use the Site. For your privacy rights and choices — including California's Do Not Sell or Share My Personal Information right — see the Your Privacy Rights & Choices section of the Privacy Policy.

2. About our services

West Sound Comfort Systems provides residential HVAC (heating, air conditioning, and heat-pump), plumbing, and electrical services in Kitsap County and the Olympic Peninsula, Washington. The Site describes those services, our service areas, financing options, promotions, and homeowner resources, and allows you to request service, apply for financing (through a third-party provider), and contact us. The Site does not create a service relationship on its own — service relationships are established by a written agreement or work order signed with West Sound Comfort Systems.

3. AI-assisted content and interactive tools

Parts of the Site's content are human-authored with the assistance of artificial intelligence, and the Site offers interactive homeowner tools that may include an AI-powered Whole-Home Comfort Advisor, a Repair-or-Replace helper, and a Kitsap Heat Pump Rebate Estimator.

These tools are for general educational purposes only. Their outputs are illustrative estimates and non-binding routing suggestions based on the information you provide. They are not a professional inspection, not a binding quote, not a warranty of a specific price, incentive, rebate, or outcome, and not a substitute for professional advice from a licensed technician. Before making any decision based on a tool's output, confirm the details in writing with a West Sound Comfort Systems representative. Rebates and incentives change frequently and are subject to the terms of the granting agency or utility.

4. Estimates, pricing, promotions & scheduling

Any estimates, pricing, promotions, financing terms, availability windows, or service descriptions on the Site (including any generated by our interactive tools) are non-binding and are subject to inspection, availability, credit approval where applicable, and confirmation in a signed written agreement or work order. Final pricing, scope, and terms are established at the time of service. Promotions may not be combined unless expressly stated, and we may modify or end them at any time.

5. No professional advice

The Site does not provide medical, legal, engineering, financial, or other professional advice. Home-comfort content, safety notes, and how-to material are for general informational purposes and are not a substitute for a professional site visit. If you have a safety concern (gas leak, electrical hazard, water intrusion, etc.), stop using the affected equipment and contact a licensed professional or 911 as appropriate.

6. Intellectual property; limited license

The Site and all of its content — including text, graphics, photography, illustrations, logos, video, audio, layouts, code, and the “West Sound Comfort Systems” name and brand — are owned by West Sound Comfort Systems or its licensors and are protected by U.S. and international intellectual-property laws. Manufacturer names and logos are the property of their respective owners and are used with permission or for identification purposes.

Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-transferable, non-exclusive license to access and use the Site for your own non-commercial, informational purposes. You may not copy, modify, publicly perform, republish, sell, or otherwise exploit any part of the Site without our prior written consent.

7. Acceptable use

You agree that you will not:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Harass, threaten, defame, or defraud any person;
• Infringe any intellectual-property or privacy right;
• Upload or transmit any virus, malware, or harmful code;
• Attempt to access, probe, or scan the Site or any related system in a way that is not authorized;
• Scrape, spider, or automatically harvest content or contact information (this Site is not licensed for training generative AI models);
• Impersonate any person or misrepresent your affiliation;
• Use the Site to send unsolicited commercial messages (spam);
• Interfere with any other user's enjoyment of the Site.

8. Your submissions

If you submit content to the Site — for example, a review, testimonial, photo, video, or written description of a job — you represent that you own or have all necessary rights to that content and that it is truthful and not misleading. You grant West Sound Comfort Systems a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, and display that content in connection with providing our services and marketing our business (including publicly displaying testimonials with attribution). You may ask us to remove content you submitted by contacting us at sales@westsoundcomfort.com.

9. Third-party services

The Site incorporates or links to third-party services, including but not limited to Google Maps, our financing partner Regions Home Improvement Financing (through Regions Bank, Member FDIC), our form-relay endpoint at api.ciwebgroup.com, analytics providers, review platforms, and messaging providers. Your use of those services is governed by their own terms and privacy policies, not ours. We are not responsible for any third-party service's content, availability, or practices.

10. Disclaimer of warranties (AS-IS / AS-AVAILABLE)

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, West Sound Comfort Systems disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site or any tool on it will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any content is accurate or complete.

The workmanship and manufacturer warranties associated with the physical products we install or service (including our 5-Year Parts & Labor Warranty where offered) are governed by their own written terms and are separate from these Terms.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEST SOUND COMFORT SYSTEMS AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — including lost profits, lost revenue, lost data, loss of goodwill, business interruption, or the cost of substitute services — arising out of or relating to the Site, your use of the Site, or these Terms, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our aggregate liability arising out of or relating to the Site or these Terms will not exceed the greater of (a) $100 or (b) the total amount you paid us for services in the twelve (12) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the limitations above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless West Sound Comfort Systems and its owners, directors, officers, employees, agents, affiliates, and licensors from and against any and all claims, damages, liabilities, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your misuse of the Site, (c) your violation of any law or third-party right, or (d) any content you submit through the Site.

13. Governing law & venue

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, any action to enforce an arbitration award or to seek injunctive or other equitable relief will be brought exclusively in the state or federal courts located in Kitsap County, Washington, and you consent to the personal jurisdiction of those courts.

14. Informal dispute resolution

Before filing an arbitration demand, you agree to first send us a written notice of your claim by mail to the address in §19, describing the nature and basis of the claim and the relief sought. We will attempt in good faith to resolve the dispute informally for at least thirty (30) days from receipt of the notice. Only if the dispute is not resolved during that period may either party commence arbitration.

15. Binding individual arbitration; class-action waiver; 30-day opt-out

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the relationship between you and West Sound Comfort Systems (each a “Dispute”) that is not resolved through informal resolution will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration will take place in Kitsap County, Washington, or such other location as the parties agree, and may be conducted by telephone or video where permitted. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and West Sound Comfort Systems agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate claims of more than one person and may not preside over any form of representative or class proceeding.

Your 30-day right to opt out. You may opt out of this arbitration provision by sending a written notice to West Sound Comfort Systems at 9619 Provost Rd NW, Silverdale, WA 98383 within 30 days of your first use of the Site. The notice must state that you are opting out and include your name, address, and a clear statement of your intent to opt out of arbitration. Opting out does not affect any other provision of these Terms.

Exceptions. Nothing in this section prevents either party from bringing an individual action in small-claims court or from seeking injunctive or other equitable relief in court to protect its intellectual-property rights.

16. Financing; pricing changes

Financing offers on the Site are provided by Regions Home Improvement Financing, through Regions Bank, Member FDIC, subject to credit approval and the terms and disclosures they provide. West Sound Comfort Systems does not extend credit directly. Prices, promotions, financing terms, and rebate estimates are subject to change without notice.

17. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms. Sections that by their nature should survive termination will survive (including intellectual-property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law).

18. Severability; entire agreement; no waiver; assignment

If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary to be enforceable, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any written agreement or work order signed with West Sound Comfort Systems, constitute the entire agreement between you and us regarding the Site and supersede all prior agreements. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them to any successor.

19. Changes to these Terms; contact

We may update these Terms from time to time. Changes are effective when posted on this page, and the “last updated” date will be revised. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
